To play poker online for real money is an unlawful activity in Germany. Those players who break the gambling ban could in theory even spend time in prison.

Michael Terhaag, a German lawyer, says ‘Honestly speaking, though, the true problem for online poker players is to enforce their winnings from online gambling providers who are usually overseas’.

According to the expert in online law, Bild Spiele, when any problem emerges the players "in general have not got any juridical options to sue a dishonest provider in order to get their money back".

Players must also know that it is impossible to exclude the possibility of cheating when gambling poker on the web. Michael Terhaag also added that he did not know a case where a gambler had been prosecuted for gambling illegal poker online.
